COVID-19
All COVID regulations should be observed and followed.
Masks are required for the safety of others and staff members.
Wash / sanitizing hands before and after entering or exiting the installation
Social distancing guidelines should be followed.
You may NOT participate if experiencing any symptoms of illness.
BVOE Q360
All participants are responsible for their conduct and well being.
BVOE Q360 is designed to be enjoyed by all ages. However, participants under the age of 18 must be accompanied by an adult 18 years of age or older.
Adults must accompany children throughout the exhibit space and are responsible for their conduct and well being.
BVOE Q360 requires a 1 adult to every 4 children
The maximum number of guest in a scheduled block is 16
No food or beverages are allowed in the exhibit space.
No smoking or combustables of any kind.
REFUNDS
There will be no refunds for missed appointments.
You may use the scheduling system provided to re-schedule your appointment.
Other refunds will be at the discretion of BVOE and its affiliates.
PARTICIPATION WAIVER
I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing. I further acknowledge that BVOE (Baron Von Opperbean Experience) has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19. I further acknowledge that BVOE Q360 (Quadrant 360) can not guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, staff, and other clients and their families. I voluntarily enter the experience provided by BVOE Q360 and acknowledge that I am increasing my risk of exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending BVOE.
I attest that:
I am not experiencing any symptoms of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.
I have not traveled internationally within the last 14 days.
I have not traveled to a highly impacted area within the United States of America in the last 14 days.
I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19.
I have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non contagious by state or local public health authorities.
I am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19.
I hereby release and agree to hold BVOE Q360 and its affiliates harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act by BVOE Q360, or that may otherwise arise in any way in connection with any services received from my participation at BVOE Q360. I understand that this release discharges BVOE Q360 and its affiliates from any liability or claim that I, my heirs, or any personal representatives may have against the exhibit with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from BVOE Q360. This liability waiver and release extends to BVOE Q360 together with all owners, partners, employees, staff, volunteers and affiliates.
I agree to grant to BVOE and its authorized representatives permission to record on photography film and/or video, pictures of my participation. I further agree that any or all of the material photographed may be used to promote the BVOE project, and further that such use shall be without payment of fees, royalties, special credit or other compensation.
I AM VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED ACTIVITY AND I AM PARTICIPATING IN THE ACTIVITY ENTIRELY AT MY OWN RISK. I AM AWARE OF THE RISKS ASSOCIATED WITH PARTICIPATING IN THIS ACTIVITY, WHICH MAY INCLUDE, BUT ARE NOT LIMITED TO: PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, AND DEATH. I UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM MY OWN OR OTHERS' NEGLIGENCE, CONDITIONS RELATED TO TRAVEL TO AND FROM THE ACTIVITY, OR FROM CONDITIONS AT THE ACTIVITY LOCATION(S). NONETHELESS, I ASSUME ALL RELATED RISKS, BOTH KNOWN AND UNKNOWN TO ME, OF MY PARTICIPATION IN THIS ACTIVITY.
I FURTHER AGREE to indemnify, defend and hold harmless the Releasees against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs.
I HEREBY ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS "WAIVER AND RELEASE" AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I EXPRESSLY AGREE TO RELEASE AND DISCHARGE BVOE Q360, Christopher Reyes, Cat and Fish, LLC., Off the Walls Arts, AND ALL OF ITS AFFILIATES, MANAGERS, MEMBERS, AGENTS, ATTORNEYS, STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNS, FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION AND I AGREE TO VOLUNTARILY GIVE UP OR WAIVE ANY RIGHT THAT I OTHERWISE HAVE TO BRING A LEGAL ACTION AGAINST BVOE Q360 FOR PERSONAL INJURY OR PROPERTY DAMAGE.
I AM THE REPRESENTATIVE OF MY GROUP/POD AND HAVE THE AUTHORITY TO AGREE TO THIS WAVIER ON THEIR BEHALF.
THIS WAIVER AND RELEASE OF LIABILITY SHALL REMAIN IN EFFECT FOR THE DURATION OF MY PARTICIPATION IN THE ACTIVITY, DURING THIS INITIAL AND ALL SUBSEQUENT EVENTS OF PARTICIPATION.
I CERTIFY THAT I HAVE READ THIS DOCUMENT; AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
